His car hit a hole that contained a mine and his daughter and wife died

I am a doctor from Iraq. I took my wife and my only daughter to visit her family, and on our way back we were in my car, and I hit a hole containing a mine which caused the car to roll over and I lost consciousness because of bleeding in the brain. As for my daughter, they said that she died less than one hour after the accident, and my wife died approximately 10 hours afterwards, as they say. I hope that you can explain to me the following matters:

1. Am I regarded as having killed my wife and daughter?

2. What are the consequences for me of this matter and what is my situation with regard to inheritance?.

Praise be to Allaah.

Firstly:

We ask Allaah to reward you for your calamity and to
compensate you with something better; and we ask Him to purify the land of
Iraq -- and all the Muslim lands -- of sinful aggressors and to grant
victory to His close friends and to humiliate His enemies, for He is able to
do that.

Secondly:

If you were driving at a speed at which you were able to
control the car and you were not able to avoid this hole, then there is no
blame on you because you were not negligent, and you do not have to offer
expiation or pay blood money.

But if you were driving at excessive speed, at which you
could not control the car, then you have to offer two counts of blood money
and two expiations for accidental killing of your wife and daughter, because
you made a mistake and caused their death.

The main issue is whether or not you were negligent, and
negligence may mean excessive speed, not paying attention to the state of
your brakes and tires, staying up too late and not sleeping, and other
things that may have been the cause of the accident.

Shaykh Ibn ‘Uthaymeen (may Allaah have mercy on him) said in
his essay Ahkaam Hawaadith al-Sayyaaraat: If the driver of the car
does something intending to escape danger, for example if he is faced with
something that he fears will harm him in a crash, or someone comes out from
the right or the left in such a way that he cannot stop, so he swerves to
avoid danger and an accident occurs, or he suddenly sees a deep hole in
front of him and he swerves to avoid it and an accident occurs -- in these
cases there are no consequences such as requiring expiation or compensation,
because he acted responsibly and did what was required of him of trying to
avoid danger, so he is in the right  and “No ground (of complaint) can
there be against the Muhsinoon (good-doers)” [al-Tawbah 9:91].

Thirdly:

If there was negligence, then the one who was negligent is
obliged to do two things: to pay blood money and offer expiation for each
one who died. But if the heirs waive the blood money, he is no longer
obliged to pay it; as for expiation, it cannot be waived.

The heirs do not have the right to waive the blood money if
the slain person owed debts or if he has heirs who are minors; rather his
debts should be paid from the blood money. An heir who is an adult of sound
mind may give up his share of the blood money if he wishes, but for the
minors their share remains due. See: al-Sharh al-Mumti’ (11/321):

The expiation for killing is freeing a slave; if that is not
possible then it is to fast two consecutive months, because Allaah says
(interpretation of the meaning): “and whosoever kills a believer by
mistake, (it is ordained that) he must set free a believing slave and a
compensation (blood money, i.e. Diya) be given to the deceased’s family
unless they remit it.” Then He says:  “And whoso finds this (the penance of freeing a slave) beyond his means, he must fast for two consecutive months in order to seek repentance from Allaah” [al-Nisa’ 4:92].

Quran word of God? - 3. Was Muhammad foretold in the Bible?:

Was Muhammad foretold in the Bible?

Last week we discussed whether Muhammad was a prophet or
not. We studied the lives of Bible prophets who exhibited identical qualities
which a prophet should have, but was missing from the life of Muhammad.
Though Muslims have claimed that Muhammad was the last prophet etc. but
we do not see the basic qualification of a prophet in his life.

3. Was Muhammad foretold in the Bible?:

Muslim Scholars have tried their best to convince the world
that Muhammad was the prophet spoken of in the Bible. In
their desperate attempts to prove their point, they did not even have
any fear to equate Yahweh God - to Muhammad. Dr. Jamal Badawi the Islamic
Scholar wrote in his article, "Muhammad in the Bible" like this,
"One of the signs of the prophet to come from Paran (Mecca) is that
he will come with "ten thousands of saints" (Deuteronomy 33:2
KJV). That was the number of faithful who accompanied Prophet Muhammad
to Paran (Mecca) in his victorious, bloodless return to his birthplace
to destroy the remaining symbols of idolatry in the Ka'bah."

Now if you have not read Deuteronomy 33:2, from Bible you
will think that Dr. Jamal Badawi is right. But let me quote the whole
verses here from KJV Bible:

Deu 33:1 And this is the blessing, wherewith Moses the
man of God blessed the children of Israel before his death.

Deu 33:2 And he said, The LORD came from Sinai, and rose up from Seir
unto them; he shined forth from mount Paran, and he came with ten thousands
of saints: from his right hand went a fiery law for them.

The above verses are very clear in speaking that LORD came
down from Sinai... shined forth from mount Paran. Verses 1-2 of Deuteronomy
33rd chapter clearly says that Moses spoke about his experience that God
came down when they camped in the place called Paran. You can also look
at Numbers 10:12 where it says, "And the children
of Israel set out from the Wilderness of Sinai on their journeys; then
the cloud settled down in the Wilderness of Paran."

If you read further you will know that God used to come
down in a cloud and pillar of fire among the Israelites in their wilderness
journey. And Moses is referring to that experience before his death as
we read in

Deu 33:1 And this is the blessing, wherewith Moses the
man of God blessed the children of Israel before his death.

Deu 33:2 And he said, The LORD came from Sinai, and rose up from Seir
unto them; he shined forth from mount Paran, and he came with ten thousands
of saints: from his right hand went a fiery law for them..

So we know that Moses was not talking about the coming prophet
using the most respected name of God "LORD" but he was simply
sharing his experience that God came down in their midst.

Dr. Jamal Badawi also claimed that, "Habakkuk
3:3 speaks of God (God's help) coming from Te'man (an Oasis North of Medina
according to J. Hasting's Dictionary of the Bible), and the holy one (coming)
from Paran. That holy one who under persecution migrated from Paran (Mecca)
to be received enthusiastically in Medina was none but prophet Muhammad."

No matter how the dictionary twist this verse and make 'God'
to appear as "God's help", Bible is very clear in Habakkuk
3.3 that, "God came from Teman as we read, "God came from Teman,
and the Holy One from mount Paran. Selah. His glory covered the heavens,
and the earth was full of his praise(Hab 3:3)."
If you read
further the 4th to 6th verses make it very clear that these verses are
talking about God and not about any human being.

Not only that, Dr. Jamal Badawi claimed that the "Parakletos"
which was spoken in the book of John 14, 15 and 16 was Muhammad. But is
it true? The Greek term Parakletos is used to refer to "Holy Spirit"
or "Spirit of Truth". Bible says in John
14:16-17, "And I will pray the Father, and He will give you another
Helper, that He may abide with you forever; the Spirit of truth, whom
the world cannot receive, because it neither sees Him nor knows Him; but
you know Him, for He dwells with you and will be in you."

John 14:26 "But the Helper, the Holy Spirit, whom
the Father will send in My name, He will teach you all things, and bring
to your remembrance all things that I said to you."

As we looked in our previous issues, "Holy Spirit"
or "Spirit of Truth" will come and dwell in us and will be a
helper, comforter and advocate for us. When Jesus promised to give another
Helper, He did not say that Muhammad (or a man) will DWELL IN YOU but
He said that "Holy Spirit" or "Sprit of Truth" will
come and live in you and guide you, lead you and teach you all things.
Spirit of Truth means Spirit of God or Spirit of Jesus as we read in John
14:6, Jesus said to him, "I am the way, the truth, and the life.
No one comes to the Father except through Me."
Jesus or God
is the Truth and Spirit of truth is called Holy Spirit. These verses do
not talk about Muhammad or an ordinary prophet but these verses talk about
God's Spirit.

All these interpretations of Islamic scholars tell us that
they are desperate to prove Muhammad's identity by twisting the Bible
verses. But they forgot that equating an ordinary person called Muhammad
with God or Holy Spirit is a great sin. It is very clear that Bible does
not talk anything about Muhammad.

The Qur’aan is a healing and a mercy to the believers

The Qur’aan is the word of Allaah that was revealed to His Prophet Muhammad (peace and blessings of Allaah be upon him) and is recited as an act of worship.

This definition of the Qur’aan is comprehensive.

Our saying “the word of Allaah” excludes the words of human beings or others.

Our saying “revealed to His Prophet Muhammad (peace and blessings of Allaah be upon him)” excludes anything that was revealed to anyone else, such as the Injeel (Gospel), Tawraat (Torah) and Zaboor (Psalms).

Our saying “it is recited as an act of worship” excludes the hadeeth qudsi (ahaadeeth in which the Prophet (peace and blessings of Allaah be upon him) narrated words from Allaah which are not part of the Qur’aan).

It brings light and gives certainty, it is the strong rope, it is the path of the righteous. It tells us of those who came before us, Prophets and righteous people, and how those who disobeyed them tasted the punishment of Allaah and were humiliated. It contains verses which speak of the miracles of Allaah and His power in this great universe. It tells us of the origins of human beings who are created from “despised water” (semen). It contains the basic principles of faith which must be embraced by every humble heart. It contains the rules of sharee’ah which tells us what is permissible and what is forbidden; what is true and what is false. It tells us of the Resurrection and the fate of human beings, either in the Fire in which they will burn and be among those who are humiliated, or in Paradise with its gardens, springs, plants and places of security.

In it there is healing for men’s hearts, light and illumination for the blind. Allaah says (interpretation of the meaning):

“And We send down of the Qur’aan that which is a healing and a mercy to those who believe (in Islamic Monotheism and act on it), and it increases the Zaalimoon (polytheists and wrongdoers) nothing but loss”[al-Isra’ 17:82]

Al-Haafiz Ibn Katheer said in his commentary on this verse:

Here Allaah tells us about His Book, which He revealed to His Messenger Muhammad (peace and blessings of Allaah be upon him) and which is the Qur’aan which “Falsehood cannot come to it from before it or behind it, (it is) sent down by the All-Wise, Worthy of all praise” [Fussilat 42:41- interpretation of the meaning], that it is “a healing and a mercy to those who believe” – i.e., it takes away the diseases in the heart such as doubt, hypocrisy, shirk, deviation and misguidance; the Qur’aan heals all of that. And it is also a mercy which brings about faith, wisdom and the pursuit of and desire for goodness. This is only for those who believe in it and follow it; for such it will be a healing and a mercy. But as for the kaafir and those who wrong themselves thereby, their hearing the Qur’aan only makes them further away (from truth) and increases them in kufr. The problem comes from the kaafir, not from the Qur’aan.

Allaah says (interpretation of the meaning):

“Say: It is for those who believe, a guide and a healing. And as for those who disbelieve, there is heaviness (deafness) in their ears, and it (the Qur’aan) is blindness for them. They are those who are called from a place far away (so they neither listen nor understand)”

[Fussilat 41:44]

“And whenever there comes down a Soorah, some of them (hypocrites) say: ‘Which of you has had his Faith increased by it?’ As for those who believe, it has increased their Faith, and they rejoice.

But as for those in whose hearts is a disease (of doubt, disbelief and hypocrisy), it will add suspicion and doubt to their suspicion, disbelief and doubt; and they die while they are disbelievers”

[al-Tawbah 9:124-125]

Qutaadah said, concerning the phrase “And We send down of the Qur’aan that which is a healing and a mercy to those who believe”: when the believer hears it he benefits from it, memorizes it and understands it. “and it increases the Zaalimoon (polytheists and wrongdoers) nothing but loss” means, they do not benefit from it, memorize it or understand it. Allaah has made this Qur’aan a healing and a mercy for the believers.

Tafseer Ibn Katheer, 3/60.

Allaah says (interpretation of the meaning):

“O mankind! There has come to you a good advice from your Lord (i.e. the Qur’aan, enjoining all that is good and forbidding all that is evil), and a healing for that which is in your breasts, — a guidance and a mercy (explaining lawful and unlawful things) for the believers”[Yoonus 10:57]

“And if We had sent this as a Qur’aan in a foreign language (other than Arabic), they would have said: ‘Why are not its verses explained in detail (in our language)? What! (A Book) not in Arabic and (the Messenger) an Arab?’ Say: ‘It is for those who believe, a guide and a healing. And as for those who disbelieve, there is heaviness (deafness) in their ears, and it (the Qur’aan) is blindness for them. They are those who are called from a place far away (so they neither listen nor understand)’”

[Fussilat 41:44]

In it is guidance for mankind, away from misguidance and to the truth.

Allaah says (interpretation of the meaning):

“This is the Book (the Qur’aan), whereof there is no doubt, a guidance to those who are Al-Muttaqoon [the pious”[al-Baqarah 2:2]

“And thus We have revealed to you (O Muhammad) a Qur’aan in Arabic that you may warn the Mother of the Towns (Makkah) and all around it, and warn (them) of the Day of Assembling of which there is no doubt, when a party will be in Paradise (those who believed in Allaah and followed what Allaah’s Messenger brought them) and a party in the blazing Fire (Hell) (those who disbelieved in Allaah and followed not what Allaah’s Messenger brought them)”

[al-Shoora 42:9]

“And thus We have sent to you (O Muhammad) Rooh (a revelation, and a mercy) of Our Command. You knew not what is the Book, nor what is Faith? But We have made it (this Qur’aan) a light wherewith We guide whosoever of Our slaves We will. And verily, you (O Muhammad) are indeed guiding (mankind) to the Straight Path (i.e. Allaah’s religion of Islamic Monotheism).

The path of Allaah to Whom belongs all that is in the heavens and all that is in the earth. Verily, all matters at the end go to Allaah (for decision)”

[al-Shoora 42:52-53]

It contains innumerable benefits, so everyone who seeks happiness in this world and in the Hereafter must refer to it for judgement and follow its commands.

Imam Ibn Hazm said:

Because the proof and the miracles indicate that the Qur’aan is the covenant of Allaah with us, we must believe in it and act in accordance with it. It has come down to us through generations of Muslims narrating it to those who came after them, which leaves no room for doubt that the Qur’aan is the one which is written in the Mus-hafs which we find everywhere. We have to follow its teachings, for it is our reference-point, because we read in it the words of Allaah(interpretation of the meaning):

“There is not a moving (living) creature on earth, nor a bird that flies with its two wings, but are communities like you. We have neglected nothing in the Book, then unto their Lord they (all) shall be gathered”

[al-An’aam 6:38]

Whatever commands and prohibitions are in the Qur’aan, we must adhere to them.

Al-Ihkaam, 1/92

Quran-Islam True Islam

"So take what the Messenger assigns to you,

and refrain from what he withholds from you"

59:7

These Quranic words which form part of verse 7 of Sura 59 have been badly manipulated by those who wish to find any justification for granting prophet Muhammad legislative powers. According to these scholars they interpret these words to mean that we must uphold everything and every word spoken by the prophet as law and refrain from everything he prohibits. With this allowance they have elevated Muhammad to being a Law maker besides God. This is in sharp violation to many Quranic verses such as 6:114, 42:21 and 66:1.

One common way of corrupting the meaning of a Quranic truth is to isolate one verse, or part of a verse, from the verses that come before it or after it. By doing so, a totally misleading meaning can be obtained.

Let us look at the following very simple example:

"O you who believe, do not approach the Salat (prayer) while intoxicated, so that you know what you are saying." 4:43

Now let us read the first few words of this verse without the remainder, we get:

"O you who believe, do not approach the Salat (prayer)"

Here we have material for manipulation, since these Quranic words command us not to observe our prayers! Obviously this manipulation was possible only because we quoted part of a verse and omitted the remainder.

The same principle can also sometimes apply when we quote one Quranic verse in isolation without reading the verses immediately before or or after it. This is exactly the case when applied to 59:7 in isolation.

It is true that the words used in 59:7 say that we should accept what the messenger gives us and refrain from what he withholds from us. But what exactly is God speaking about here? Do these words mean that the messenger has the authority to legislate and we to accept him as a law maker? What do the words before these words in 59:7 say? Well, by reading the whole verse the picture becomes totally different from what the manipulators are claiming:

Sura 59, verses 6-7:

Whatever God restored for His messenger was not the result of your war efforts, whether you fought on horses or on foot. God is the One who sends His messengers against whomever He wills. God is Omnipotent.

That which God gives as spoil unto His messenger from the defeated towns, it is for God and His messenger and for the relatives, the orphans and the needy and the traveling alien. Thus, it will not remain monopolized by the strong among you. So take what the Messenger assigns to you, and refrain from what he withholds from you. You shall reverence God. God is strict in enforcing retribution."

By reading these glorious Quranic words we arrive at the following important issues:

1- These two verses (59:6-7) speak very clearly about the spoils of war and nothing else. The words "that which God gives as spoils from the defeated towns" confirm that the subject is the spoils of war.

2- More important the source of what is given to the people by the messenger "what the messenger asigns to you" is God and not the messenger. This is confirmed with the words "what God restored for His messenger". What this means is that whatever is given to the believers, and even though is given by the messenger, yet the source is still God. The spoils of war are given to the messenger in order that he may distribute them in accordance to God's rules.

3- We read that the messenger is told specifically how to distribute these spoils of war: "for the relatives, the orphans, the needy, and the traveling alien".

4- Following these words, God says that the believers should accept what the messenger gives them (of the spoils) and refrain from what is not given to them. In other words, God is telling the believers to accept the way the messenger distributes these spoils of war without grumbling.

5- The words "so it would not remain monopolised by the strong among you" is further conclusive proof that God is not speaking about the hadith or sunna of the messenger but is speaking about material gains, i.e the spoils of war.

6- The conclusion is that these two verses have been badly manipulated by those who would go to any lengths to justify the legality of sunna. As we have just seen they would even manipulate God's own words in order to justify their hadith and sunna. And to justify this false claim they took few words out of 59:7 "take what the messenger gives you" and quoted them in isolation in order to deceive.
